Artist Agreement | Artemble

This Agreement governs the relationship between Artemble (the Platform) and each Artist accepted to list and sell original works through the platform. By completing the artist application and accepting an offer of representation, the Artist agrees to be bound by the following terms.

1.Non-Exclusive Representation

Artemble offers non-exclusive representation. Artists may simultaneously sell their work through other galleries, platforms, online marketplaces, and direct channels. Artists must notify Artemble immediately if a work listed on Artemble is sold through another channel.

2.Commission Structure

Artemble retains a commission on each sale. The Artist receives the remainder as follows:

€500 – €3,000	65%
€3,001 – €10,000	68%
€10,001 – €25,000	72%
€25,001 and above	78%

Commission is calculated on the final listed sale price, exclusive of shipping costs.

3.Payment Terms

Artist payouts are processed within 7 business days of confirmed delivery to the collector. Payment is made via international bank transfer to the account details provided by the Artist in their dashboard. International transfer fees are covered by Artemble.

4.Artwork Warranties

By submitting a work for listing, the Artist warrants that the work:

4.1Is an original creation, entirely conceived and executed by the Artist

4.2Is not copied, substantially derived from, or infringing upon any other artist's work

4.3Is free from any third-party intellectual property claims, liens, or encumbrances

4.4Is accurately described - medium, dimensions, year of creation, and condition are truthful

4.5Is a contemporary work created by the applying Artist

4.6Is not an antique, reproduction, print (unless explicitly listed as such), or work over 100 years old

5.Image Rights

The Artist grants Artemble a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use images of listed works on the Artemble platform, in social media, press coverage, marketing materials, and editorial content for the purposes of promotion and sale. This licence applies only to works actively listed on the platform and expires upon removal of the work.

6.Packaging & Shipping

6.1The Artist is responsible for packaging the work safely and appropriately for international transit

6.2Artemble provides a prepaid, fully insured shipping label via our logistics partner

6.3The Artist must ship within 5 business days of receiving notification of a sale

6.4The Artist must enter the tracking number into their Artemble dashboard within 24 hours of drop-off

6.5Artemble provides packaging guidance - the Artist is encouraged to follow it carefully

7.Certificate of Authenticity

Every sold work ships with a Certificate of Authenticity issued by Artemble and co-signed by the Artist. The Artist agrees to provide accurate information for the certificate upon request.

8.Availability

Works listed on Artemble must remain available for purchase. If a listed work is sold elsewhere, the Artist must notify Artemble and remove the listing within 24 hours.

9.Platform Rights

Artemble reserves the right to:

9.1Decline any submitted work at curatorial discretion, without obligation to provide reasoning

9.2Remove any listed work from the platform at any time

9.3Suspend or terminate an Artist's account for breach of this Agreement, provision of false or misleading information, or conduct that damages the reputation of the platform

9.4Adjust the commission structure with 30 days written notice to active Artists

10.Artist Conduct

Artists agree not to contact collectors directly outside of the Artemble platform for the purpose of transacting on works listed or previously listed on Artemble. Artists agree to respond to packing and shipping notifications within the timeframes set out in Clause 6.

11.Confidentiality

Artists will not disclose collector information - names, addresses, or contact details - received through the platform to any third party, nor use it for any purpose other than fulfilling the shipment.

12.Governing Law

This Agreement is governed by applicable law. Any disputes arising from this Agreement shall be resolved through binding arbitration. The laws of India apply as the substantive law of this Agreement under the Arbitration and Conciliation Act, 1996.

13.Entire Agreement

This Agreement constitutes the entire agreement between Artemble and the Artist with respect to the Artist's listing and sale of works on the platform. It supersedes all prior communications on this subject.
